Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Klenz ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

2. Description of Service

Klenz is an AI-powered nutrition tracking and food scoring application. The app allows you to log meals, track nutrients, scan barcodes and restaurant menus, log symptoms, and receive AI-generated nutrition insights. Klenz uses machine learning models and USDA nutritional databases to evaluate the nutrient composition of foods.

Klenz also lets you create a grocery shopping list and send it to a third-party provider, such as Instacart, to purchase ingredients for delivery.

3. Not Medical Advice

Klenz is not a medical device and does not provide medical advice, diagnosis, or treatment.

The Klenz Score, health area assessments, nutrient tracking, AI-generated insights, and all other information provided through the app are for informational and tracking purposes only. These features evaluate the nutrient composition of foods and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

You should always consult a qualified healthcare provider before making changes to your diet, especially if you have a medical condition, food allergies, or are taking medication. Never disregard professional medical advice or delay seeking it because of information provided by Klenz.

4. AI and Machine Learning Limitations

Klenz uses artificial intelligence and machine learning to identify foods, estimate nutritional content, score meals, and generate insights. While we strive for accuracy, you should be aware that:

You must be at least 13 years of age to use Klenz. If you are under 18, you must have permission from a parent or legal guardian.

You are responsible for maintaining the security of your account and email address used for authentication. You agree to provide accurate information and to notify us promptly if you believe your account has been compromised.

We reserve the right to suspend or disable your account at our discretion if we reasonably believe you have violated these Terms or are using the app in a manner that could harm Klenz, its users, or its systems. We will make reasonable efforts to notify you if your account is disabled.

You may delete your account at any time by submitting a request at https://forms.gle/MG9q1VruoxgEdbFC7. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

9. Intellectual Property

All content, features, and functionality of Klenz — including the Klenz Score model, algorithms, design, text, and graphics — are owned by Klenz and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app without our prior written consent.

10. Changes to the Service

Klenz is continuously evolving. We may add, modify, or remove features, functionality, or content at any time to improve the app, address performance or security issues, or comply with applicable laws and regulations. While we strive to minimize disruption, we do not guarantee that any particular feature will remain available. You agree that Klenz shall not be liable to you or any third party for any modification, suspension, or discontinuation of any feature or part of the service.

11. Subscription and Payments

Klenz requires a paid subscription ("Klenz Premium") to access the app after the free trial period.

Prices may vary by location and are displayed in your local currency at the time of purchase.

A 7-day free trial is available for new subscribers. No charge is made during the trial period.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your device's subscription settings.

12. Third-Party Services

Klenz integrates with third-party services including AI processing providers, analytics tools, crash reporting services, and grocery shopping providers such as Instacart (see Section 13). Your use of the app is also subject to the terms and policies of these third-party providers. We are not responsible for the practices or content of third-party services.

13. Grocery Shopping & Third-Party Fulfillment

Klenz lets you create a grocery shopping list and send it to a third-party grocery provider, such as Instacart, to purchase ingredients.

When you use this feature, Klenz creates a shopping list on the provider's platform and directs you there to complete your order. All purchases are made directly with the provider, not with Klenz. The provider — not Klenz — is solely responsible for pricing, product availability, substitutions, payment processing, fulfillment, delivery, returns, and refunds. Klenz is not a party to your transaction and is not responsible for any issues with your order.

Your use of the provider's platform is governed by that provider's own terms of service and privacy policy. You must meet the provider's eligibility requirements, including being at least 18 years old, to place an order.

Grocery lists reflect the nutrient composition of foods and are provided for tracking and shopping convenience only. They are not medical advice, dietary prescriptions, or treatment recommendations (see Section 3). You are responsible for confirming that any foods you purchase are appropriate and safe for you, including checking for allergens and ingredients you need to avoid (see Section 4).

Klenz may earn a commission when you place an order through a grocery provider. This does not affect the price you pay.

14. Disclaimer of Warranties

To the maximum extent permitted by law, Klenz is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that any nutritional data, scores, or AI-generated content will be accurate, complete, or reliable.

15. Limitation of Liability

To the maximum extent permitted by law, Klenz and its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or damages arising from your reliance on information provided by the app.

Our total liability for any claim arising from your use of Klenz shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

16. Indemnification

You agree to indemnify and hold harmless Klenz and its owner from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the app or violation of these Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in New York, New York.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app. Your continued use of Klenz after changes are posted constitutes your acceptance of the updated Terms.
