1. Acceptance of Terms

By downloading, accessing, or using Klenz ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

2. Description of Service

Klenz is an AI-powered nutrition tracking and food scoring application. The app allows you to log meals, track nutrients, scan barcodes and restaurant menus, log symptoms, and receive AI-generated nutrition insights. Klenz uses machine learning models and USDA nutritional databases to evaluate the nutrient composition of foods.

4. AI and Machine Learning Limitations

Klenz uses artificial intelligence and machine learning to identify foods, estimate nutritional content, score meals, and generate insights. While we strive for accuracy, you should be aware that:

• AI-based food identification from photos and menus may not always be accurate
• Nutritional estimates are approximations based on USDA reference data and may not reflect the exact composition of your specific meal
• The Klenz Score reflects the nutrient composition of foods based on our model and should not be interpreted as medical guidance
• AI-generated insights and recommendations are based on your logged data and general nutritional information, not clinical assessment
• Barcode scan results, including ingredient analysis, are based on available product data and may not reflect recent product reformulations

You are responsible for verifying any information that is important to your health, including allergen content.

5. Eligibility

You must be at least 13 years of age to use Klenz. If you are under 18, you must have permission from a parent or legal guardian.

6. Your Account

You are responsible for maintaining the security of your account and email address used for authentication. You agree to provide accurate information and to notify us promptly if you believe your account has been compromised.

7. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to the app's systems, servers, or databases
• Interfere with or disrupt the app's functionality or infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use automated systems, bots, or scrapers to access the app
• Misrepresent your identity or impersonate another person
• Use the app to collect data about other users

8. Account Suspension and Termination

We reserve the right to suspend or disable your account at our discretion if we reasonably believe you have violated these Terms or are using the app in a manner that could harm Klenz, its users, or its systems. We will make reasonable efforts to notify you if your account is disabled.

You may delete your account at any time by submitting a request at https://forms.gle/MG9q1VruoxgEdbFC7. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

9. Intellectual Property

All content, features, and functionality of Klenz — including the Klenz Score model, algorithms, design, text, and graphics — are owned by Klenz and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app without our prior written consent.

10. Beta Service

Klenz is currently available as a beta product. The app is provided on an "as is" and "as available" basis. Features may change, be removed, or experience interruptions without notice. We do not guarantee uptime, availability, or the accuracy of any data during the beta period.

11. Pricing

Klenz is currently free to use during the beta period. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will provide advance notice and you will not be charged without your consent.

12. Third-Party Services

Klenz integrates with third-party services including AI processing providers, analytics tools, and crash reporting services. Your use of the app is also subject to the terms and policies of these third-party providers. We are not responsible for the practices or content of third-party services.

13. Disclaimer of Warranties

To the maximum extent permitted by law, Klenz is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that any nutritional data, scores, or AI-generated content will be accurate, complete, or reliable.

14. Limitation of Liability

To the maximum extent permitted by law, Klenz and its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or damages arising from your reliance on information provided by the app.

Our total liability for any claim arising from your use of Klenz shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Klenz and its owner from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the app or violation of these Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in New York, New York.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app. Your continued use of Klenz after changes are posted constitutes your acceptance of the updated Terms.
